Parents filed a petition

According to media reports, parents were demanding admission in Class 1 despite their children not turning 6 years old by June 1, 2023, as per the amended Right to Education Act and the guidelines issued for the new education policy. The minimum age for children to enroll in school is 6 years.

It is illegal to enroll under the age of three

The petitioner parents had argued that their children were sent to preschool before they turned three years of age. Now that they have spent three years there, they should be given some relaxation in the ‘minimum age rule’.

Under this, they should be given admission in first class even before the age of 6 years. However, the bench rejected their argument, saying, “Forcing the children to go to pre-school before they turn three years of age is an illegal act on the part of the petitioner parents.

The court said that the argument that children are ready for school because they have completed three years of elementary education in preschool does not impress us at all. Prohibits admission of child to preschool.

The court said that the minimum age requirement under RTE has been implemented in Gujarat. A petition challenging Rule 8 of the RTE Act was dismissed in 2013.

The High Court said, ‘The petitioners (parents of the children), who have not taken care of their children turning 6 years of age by June 1 of the year 2023, cannot demand any kind of concession or exemption as they are under the RTE rules. , are guilty of violating the mandate of 2012, which is in line with the RTI Act, 2009.
