There is great news for the employees. The High Court has given an important order regarding the increase in the retirement age. With the order of the High Court, it is clear that the retirement age for state government employees will be increased from 60 to 62.

In fact, the High Court has given an important order on increasing the retirement age of employees in Andhra Pradesh to 62 years. The High Court has held that the orders given by the State Government to increase the retirement age will not be applicable to the employees working in Corporations and Societies related to the Government.

The Andhra Pradesh High Court has also set aside a judge’s decision to increase the retirement age of employees working in the corporation to 62 years. The AP Public Employment 1984 clarified that the retirement age of government employees drawing salary from the Consolidated Fund, including employees appointed only under public service and directly connected with government affairs, would be 62 years.

Single Court’s decision- Instructions to increase the retirement age from 60 to 62 years-
Last year, separate writ petitions were filed by the employees of the AP Education Welfare Infrastructure Development Corporation and employees of other corporations seeking an annual salary hike. Single judge heard the case. The retirement age of the petitioner will be increased from 60 to 62 years while delivering the judgment in September last year.

The lawyers argued

Challenging the orders, the MD and head of school education, APEWDC, filed an appeal in December. Advocate General S.K. Sreeram argued that the order increasing the retirement age for state government employees was applicable only to state government employees. He said that some corporation has decided to increase the retirement age to 62 years without the prior permission of the government, which is illegal.

On behalf of the same petitioner, the advocates said that the employees working in the corporation are working under government control. Therefore, the retirement age of 62 years does not apply to them. Giving information on which it was told that the service rules of the employees of the corporation and the society have not been made under Article 309 of the Constitution. They have special service rules. In such a situation, the authorized officer will appoint the employee of the corporation at the age of retirement. The corporation will also pay the salary. Salary will not be paid from the same accumulated fund.

The tribunal has clarified that the employees of the corporation will be ineligible to get benefits under the AP Public Employment Act, 1984. After the order of the High Court, now the retirement age of the employees of the corporation will not be 62 years.
