informed in the memorandum that now in cases where a Government servant dies during the penalty period, at the end of which he would have received the same salary as he would have received if he had not been fined.
The pension and death gratuity in respect o such Government servant shall be determined on the basis of notional pay to which he would have been entitled on the date of death. This order has been implemented with immediate effect. Also, old cases will not be reopened. However, such cases can be considered, which have not yet been determined regarding pension and death gratuity.

example, hypothetically, suppose the fine is imposed for four months, say from October to January and the salary of a government employee goes from Rs.15 thousand to Rs.10,000. Now if the government employee dies in December, the family pension and death gratuity for the family members of the government employee will be calculated on the basis of Rs 15,000 and not on the basis of Rs 10,000 (penalty pay).
