Pension – Family pension including gratuity will be given to the defense employees across the country. for which the instructions have been prepared. At the same time, information has been sent by PCDA. 

According to which, for the commissioned officers retiring in the defense service, pension – gratuity, retired gratuity including retired pension, computation, disability pension, family pension etc. will be applicable. A big announcement has been made for this. The benefit of which will be given to pensioners.

Notification No. 42 (30) P&PW/89/E dt. based on Rule 3(O) of CCS(P)Rules and DP&PW The pension under 22.1.91 will include gratuity. Except when the term pension is used in contrast to gratuity but does not include dearness relief. The grant of pension is subject to good conduct. In future, good conduct will be an implied condition for every type of pension.

retired pension

The minimum qualifying service required to earn retired pension is 20 years in case of Permanent Regular Commissioned Officer and 15 years in case of Late Enterers and in respect of EC/SSC. India Ministry of Defense letter no. 17(4)/2008(2)/d(pen/pole) d. 12.11.2008 Authority: Commissioned by rank to government officers for 12 years (including rank service).

service qualifying for pension

The minimum period of service qualifying for earning retired pension shall be 20 years (15 years in case of late entrants). With effect from 01/01/2006, linking of full pension with 33 years of qualifying service has been done away with. A fraction of a year equal to 3 months and above but less than 6 months shall be treated as a full half year.

Similarly, nine months or more but less than one year will be treated as a competitive one year and will be treated as qualifying service. However, this will not be applicable for completing the minimum qualifying service for award of pension.

Service Qualifying for Pension Period of Service

  • Serving as a Permanent Regular Commissioned Officer
  • Service rendered before attaining the age of 17 years.
  • In embodied or call out service as an officer of TA or Assistant Air Force, subject to refund of gratuity, if any.
  • Refund of gratuity, if any, if service in the rank is followed by permanent regular commissioned service without break.
  • All leave including study leave with pay.
  • Period of suspension from duty when the officer is not brought to trial or court martial with consequences favorable to the officer.
  • Service under Central Government Office/Department/Ministry.
  • Any period of civil service under the Central Government. Subject to refund of gratuity, if any, after military service.

Secondment subject to the following maxima

  • Pre-date of commission – 18 months
  • seconds -12 months
  • When both ex-date and secondment were provided – 24 months

retirement gratuity

An officer who has completed 5 years of qualifying service (actual) and is eligible for retired/invalid/special pension or gratuity of any kind, shall be entitled to emoluments countable for each completed six monthly period of qualifying service.

Retirement gratuity will be provided. Maximum 16 1/2 times of the computed emoluments limited to Rs.10 lakhs. The term “countable emoluments” includes Pay in the Pay Band, Grade Pay, Military Service Pay, NPA, if any, as well as Dearness Allowance admissible on the date of retirement/invalidation.

disability allowance

When an officer is invalidated because of a disability and is due or aggravated by military service and is assessed and accepted at 20% or more, he is granted a disability pension. Disability pension consists of two elements. In other words.

Service element and disability element. The service element is equal to the prescribed retired pension. Disability element for 100% disability for various ranks Minimum 30% of the last drawn emoluments or Rs. 3510/- per month will be available. In case of 100% disability, it will be reduced proportionately.

special family pension

Special family pension is admissible only if the death of an officer, whether in service or after retirement, is due to circumstances mentioned in Category ‘B’ or ‘C’. There shall be no condition of minimum service on the date of death for grant of special family pension.

The decision whether the cause of death is attributable to service or aggravated or otherwise rests with the Government of India (now Service Headquarters wef 14.8.

Eligible family members for special family pension

Sons/unmarried daughters/widow/divorced daughters (including illegitimate and legally adopted daughters) until he attains the age of 25 years or till the date of his marriage/remarriage, whichever is earlier. In case the eligible child is physically or mentally handicapped and unable to earn a livelihood, special family pension will be admissible for life.

Special Family Pension Rates

Special family pension will be calculated at the rate of 60% of the emoluments drawn at the time of death of the officer subject to a minimum of Rs. 7000/- per month irrespective of whether the widow has children or not.

There will be no maximum limit on special family pension. Pay in the Pay Band in “countable emoluments”, Grade Pay, MSP, NPA, if any, will be finally drawn by the officer.
