Big relief will be given to the employees-pensioners by the state government. In fact, after the decision of the High Court, the employees who retired after 2016 will be given the benefit of encashment of earned leave. Office order has been issued for this.
Employees Leave Encashment: There is good news for the employees-pensioners. Actually they can be given the benefit of leave encashment. For this, orders have been issued by the state government. With the issued order, the way for payment of encashment of earned leave of employees-pensioners has also been cleared. The office order has been issued by the Secretary, Finance Department.
One time settlement formula ended
In Himachal Pradesh, the one-time settlement formula implemented from March 12, 2013 for leave encashment for employees on retirement has been abolished. After the order of the High Court, the government had to take this important decision. For this, an office order was issued by Akshay Sood, Secretary, Finance Department. In which instructions have been given to bring the order of the High Court to the notice of all the departments.

With the issue of the office order, pensioners were now under the One Time Settlement formula in the matter of leave encashment. The system of lump sum amount received once will be changed. After this decision, the way for payment of leave encashment has also been cleared for all the employees retiring after 2016.
Earlier, with the implementation of the new pay commission on January 1, 2016, the DCRG was also revised by the Himachal government. After which leave encashment will also be paid through revised pay scale only.
Will get the benefit of live-encashment
Along with the issue of the office memorandum, pensioners retired from January 1, 2016 will be given the benefit of live-encashment on the lines of DCRG as per the pay scale of the revised pay scale. After the new pay scale came into force on January 3, 2022, the Finance Department gave instructions in February for pensioners to revise the pension of the retired employees of January 2016 as well.
However, after the pay scale was revised, the employees who had retired earlier were not given the benefit of leave encashment. Because of this the matter was challenged in the High Court by Amita Gupta. Now after the decision of the High Court in favor of the employee, the pensioners who retired after 2016 have got relief. Along with this, they are to be paid encashment of earned leave.
Amita Gupta challenged the formula
Explain that the government employee is given the benefit of leave encashment on retirement equal to 10 months of basic pay. A new formula was released on 12 March 2013. After which this formula was challenged by Amita Gupta, who retired as Senior Architect on 30 September 2020.
High court gave instructions to the state government
On the other hand, during the hearing in this matter, the High Court had directed the state government to pay encashment to all the pensioners accordingly so that unnecessary litigation can be avoided. On the other hand, after the order of the High Court, the office memorandum has been issued by the Finance Department of the State Government on April 2023.
