But the division bench of the High Court had set aside that order.

These employees will get benefits

Actually, the Supreme Court gave this decision on the appeal of Karnataka Power Transmission Corporation Limited (KPTCL), owned by the state government. The Supreme Court said that all such government employees are entitled to get annual increment, who have not retired till that period, all such employees should be given financial benefits even if they retire only a day after getting this benefit. Go.

Employees entitled to annual increment

KPTCL challenged the division bench of the Karnataka High Court, which held that the employees were entitled to annual increments even if they retired the very next day. A bench of Justice MR Shah and Justice CT Ravikumar dismissed the petition of KPTCL and said that it has been argued on behalf of the appellant (KPTC) that the annual increment is in the form of incentive and it is to encourage the employee to perform well. Hence, there is no question of annual increment when he is not in service. There is no point in this argument.

The Supreme Court gave this decision

The bench said that annual increments are granted to a government servant on the basis of his good conduct during one year of service, provided the same is not withheld as a punishment or linked to efficiency. Therefore, increment is earned for rendering service with good conduct during a year or a certain period of time.

The eligibility for the benefit of annual increment is on account of the service already rendered. Just because an employee is due to retire the next day, he cannot be denied the benefit of annual increment which he has earned for good service during the passing year.
