No employee will get paid leave for more than 30 days in a calendar year. If the leave of an employee is more than 30 days, then the company or employer will have to pay for the extra leave. However, these laws are yet to be implemented in the country.
There will be changes in labor law
There are 29 Central Labor Laws in India divided into 4 codes. The rules of the code include 4 labor codes like Wages, Social Security, Industrial Relations and Occupation Safety and Health and Working Conditions etc.
These four codes have been passed by the Parliament, but apart from the Centre, state governments are also required to notify these codes and rules. Only after that these rules will be implemented in the states. Here employee means managerial and supervisory role.
When will labor law be applicable
Employees in India have been demanding implementation of labor code rules for a long time. With this, employees will get 3 days leave in a week instead of 2 days. However, working hours will increase but three days of leave will be available.
The chances of enforcement of labor code rules are slim, mostly due to the general elections due next year. There is little hope of its implementation before the general elections. The rules of the labor code have been made to improve the interests of the employees.
These will be the rules
According to a report in ET, Section 32 of the Occupational Safety, Health and Working Conditions Code, 2020 (OSH Code) has several conditions regarding annual leave, carry forward and encashment.
Section 32(vii) allows an employee to carry forward annual leave up to a maximum of 30 days to the next calendar year. If the annual leave balance at the end of the calendar year exceeds 30, the employee shall be entitled to carry forward the excess leave to the next year.
