In fact, an important decision of the Supreme Court has come on the decision of the High Court. After which the employees will not be able to get the benefit of the old pension scheme till February 2024. The Supreme Court has stayed the order of the High Court.

Lakhs of Central Paramilitary Forces personnel could have got the benefit of the old pension scheme. For this, on January 11, the Delhi High Court gave a big decision. In which CRPF employees and jawans were instructed to implement the old pension system. A petition was filed in the Supreme Court in this matter by the Central Government. The Supreme Court has given a stay order on the order of the Delhi High Court. The stay order was given by a bench of Supreme Court Justices Sanjiv Khanna, and Bela Trivedi.

Next hearing in February 2024

After a long hearing, a bench of Justices Sanjeev Khanna and Bela Trivedi issued a notice and stayed the implementation of the Delhi High Court order. Solicitor General Tushar Sharma appeared in the Supreme Court on behalf of the Central Government. The same Justice Bench says that the implementation of this decision will be stayed to the extent that it has been directed that the old pension scheme will be applicable to paramilitary forces as well. In such a situation, its next hearing has now been fixed in February 2024.

Petitioners’ Argument

In this case, the petitioners argue that they were offered appointment to the post of Assistant Commander from October 2004 to 2005. A notification was issued by the government in 2003. The new contributory pension scheme was implemented in January 2004. However, the scheme was not applicable to the armed forces as the old pension scheme already existing in the forces was retained. The petitioners in the case contended that those who were appointed after the implementation of NPS due to administrative delay by the government should get the benefit of the old pension scheme as they were selected for the job earlier. However, the appointment was given to him later.

Delhi High Court’s decision

Let us inform that earlier the Delhi High Court had given an important decision. In its judgment, the Delhi High Court held that the Central Paramilitary Forces are the Armed Forces of the Indian Union. In such a situation, the court had asked to strike down the NPS in the central paramilitary forces. Not only this, the Delhi High Court had clearly said that whether someone is recruited today or earlier, will be recruited in the coming times. All jawans and officers will come under the purview of the old pension scheme. The judgment in this matter was pronounced by the Delhi High Court on 11 January. Instructions were given to implement the old pension scheme within 8 weeks. The period given by the court had expired. The central government had sought 12 weeks time from the court. The Central Government argued before the High Court, stating that it had sought time to consider the issue.

Can become an election issue

Explain that in the case of the central government, it is not ready to consider the central paramilitary forces as armed forces. The issue of old pension scheme is also stuck in this cycle. All employees recruited in 2004 in central government jobs were taken out of the purview of the old pension scheme, while CAPFs have also been taken out of the old pension scheme along with civil employees. The government believes that the army, navy and air force are the only armed forces in the country, while looking at the demand for the old pension scheme, it is believed that the capf employees union can make it a big issue for the elections to be held in 2024.
